THE CONTROLLER complies with the obligations and requirements of REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation), hereinafter referred to as THE REGULATION, as well as with any other applicable legislation in force at any given time, and ensures the proper use and processing of the data subject’s personal data.

For this purpose, together with each personal data collection form, THE CONTROLLER will inform THE DATA SUBJECT of the specific conditions applicable to the processing of their data in each case, and will request THE DATA SUBJECT’s express consent, informing them of the data controller, its address, and the possibility of exercising their rights of access, rectification, erasure, restriction, information, portability, as well as the right not to be subject to automated decision-making. The data subject will also be informed of any data disclosures to third parties, if applicable.

The personal data provided by THE DATA SUBJECT will not be disclosed to third parties, except when necessary in order to correctly provide the requested services in accordance with THE REGULATION and other applicable legislation.

THE CONTROLLER does not, under any circumstances, sell the data provided by THE DATA SUBJECT.

Likewise, THE CONTROLLER informs THE DATA SUBJECT that express consent will be requested when processing their email address for commercial purposes, in order to provide them with commercial information relevant to the interests stated in their request.

Personal data to be processed

Only the data necessary for the purpose for which it has been collected will be processed. For example: identification data, contact data, academic and professional data, and social circumstances.

Lawful basis for processing

The processing of THE DATA SUBJECT’s data by THE CONTROLLER is based on the express consent previously requested from THE DATA SUBJECT, which may be withdrawn at any time.

Processing is also lawful when it is necessary to fulfil any contractual obligations we have undertaken with you or to take pre-contractual steps at your request.

Processing may also be lawful when it is necessary to comply with obligations imposed by applicable legislation.

Furthermore, processing may be lawful when it is necessary for the legitimate interests of THE CONTROLLER, provided that such processing does not unduly affect the interests, rights or fundamental freedoms of THE DATA SUBJECT.

In any case, if THE DATA SUBJECT withdraws their consent, the lawfulness of processing carried out prior to such withdrawal will not be affected.

The consents obtained for the purposes mentioned are independent, therefore THE DATA SUBJECT may revoke any of them without such revocation affecting the remaining consents given.

Purpose of processing

Personal data will be processed in order to maintain professional, informational and commercial relationships related to our activity, provided that THE DATA SUBJECT expressly consents, as well as for the provision of contracted services or the management of the relationship with THE DATA SUBJECT.

For administrative procedures related to the fulfilment of contractual obligations or obligations imposed by applicable legislation.

To register THE DATA SUBJECT as an employee, collaborator, client or supplier of our services.

When THE DATA SUBJECT expressly consents to their data being used for educational and promotional purposes related to THE CONTROLLER’s activity.

To whom may we disclose personal information?

As a general rule, personal data will not be disclosed to third parties.

However, depending on the type of data processing activities carried out on each occasion, THE CONTROLLER may be obliged to disclose THE DATA SUBJECT’s personal information to various public or private bodies or entities in compliance with applicable legislation.

Likewise, THE DATA SUBJECT’s personal information may be made available to Public Administrations, Judges and Courts, if required from THE CONTROLLER, in compliance with applicable legislation.

In addition, if THE DATA SUBJECT authorises it, their personal data may be disclosed to collaborating companies or entities. If THE DATA SUBJECT does not authorise such disclosure in these cases, we will not be able to provide the service.

Data retention period

THE DATA SUBJECT’s data will be retained by THE CONTROLLER for as long as necessary to fulfil the above purposes, in accordance with applicable legislation, or until THE DATA SUBJECT objects to the processing or withdraws their consent.

Recipients of personal data

Personal data may be processed by THE CONTROLLER’s staff, by companies related to THE CONTROLLER, by THE CONTROLLER’s service providers, or by collaborators, for the purposes mentioned above.

Exercising your rights

Accordingly, THE DATA SUBJECT may at any time exercise their rights of access, rectification, erasure, restriction, information, portability, as well as the right not to be subject to automated decision-making, by sending a request by post to THE CONTROLLER at the postal address: Calle General Margallo, 24, Madrid 28020, attaching a copy of their ID card or passport, indicating the right they wish to exercise and addressing it to the Data Protection Department (LOPD); or by sending an email to lopd@madridabogados.es, attaching a copy of their ID card or passport and clearly stating their request.

THE DATA SUBJECT may exercise their rights before the Spanish Data Protection Agency (AEPD) if they consider that THE CONTROLLER may have infringed their personal rights.

Accuracy of the information provided by the user

All information provided by THE DATA SUBJECT must be accurate. For this purpose, THE DATA SUBJECT guarantees the authenticity of all data communicated when completing the required forms.

Likewise, it is THE DATA SUBJECT’s responsibility to keep all information provided to THE CONTROLLER permanently updated so that it reflects, at all times, the current situation of THE DATA SUBJECT.

In any case, THE DATA SUBJECT shall be solely responsible for any false or inaccurate statements made and for any damages caused to THE CONTROLLER or third parties as a result of the information provided.

Security measures to protect personal data

THE CONTROLLER undertakes to maintain the strictest confidentiality regarding the collected data and to adopt the necessary security measures to ensure data security, taking into account the state of the art, implementation costs, and the nature, scope, context and purposes of processing, as well as the varying likelihood and severity of risks to the rights and freedoms of natural persons.

International data transfers

No data transfers outside the European Union will be carried out.

Changes to the privacy policy

The privacy policy will be reviewed whenever there are changes in legislation or in any of the personal data processing procedures.

THE CONTROLLER reserves the right to modify this Privacy Policy in order to adapt it to legislative, case-law or interpretative developments by the Spanish Data Protection Agency.

In the event of future changes, the modifications made will be clearly indicated in due time, either on the website in a clearly visible manner or through email communications to THE DATA SUBJECT, and such modifications must be accepted whenever required.
